Terms and conditions of sale

Conditions

Please read these terms and conditions of sale carefully. You will be asked to accept these conditions when completing your order. Nothing in these Terms and Conditions shall affect your statutory rights as a Consumer.

These Terms and Conditions shall apply to all contracts for the sale of Goods by the Seller to the Buyer and shall prevail over any other documentation or communication from the Buyer.

Any variation to these Terms and Conditions (including any special terms and conditions agreed between the parties) shall be inapplicable unless agreed in writing by the Seller.

Ordering

All orders for Goods shall be deemed to be an offer by the Buyer to purchase Goods pursuant to these Terms and Conditions and are subject to acceptance by the Seller.  The Seller may choose not to accept an order for any reason.

Where the Goods ordered are out of stock you shall be notified and given the option to either wait until the Goods are available from stock or cancel the order and receive a full refund within 5 days.
 

Every effort is made regarding the accuracy of all colours, sizes and measurements but they are approximate.

Price and Payment

All prices are displayed in Sterling (GBP) and is inclusive of VAT at the prevailing rate.  

The total purchase price, including VAT and delivery charges, if any, will be displayed in your shopping cart prior to confirming the order.

After the order is received we will confirm by email the details, description and price for the Goods. If you do not receive a Confirmation email, please contact us to ensure your Order has been accepted.

Payment of the price plus VAT  shall be made at the time of order by credit/debit card or by Paypal/Amazon account.

Every effort is made to ensure that all prices and descriptions on our website are accurate, however errors may occur. In such an event of an error we will inform you as soon as possible and give you the option of cancelling the order or accepting the new price or description. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund.

Acceptance of your order and the completion of the contract between you and us will take place on despatch to you of the products ordered unless we have notified you that we do not accept your order or you have cancelled it (please refer to cancellation and returns).

Rights of Seller

We reserve the right to periodically update prices on the Website, which cannot be guaranteed for any period of time.  We shall make every effort to ensure prices are correct at the point at which you place an order.

We reserve the right to withdraw any Goods from the Website at any time.

We shall not be liable to anyone for withdrawing any Goods from the Website or for refusing to process an order.

Delivery

Goods supplied will normally be delivered within 3 - 7 days of acceptance of order. Please refer to the product page details for an accurate lead-time on delivery.

Where a specific delivery date has been agreed, and where this delivery date cannot be met,  you will be notified and given the opportunity to agree a new delivery date or receive a full refund.

We shall use all reasonable endeavours to meet any date agreed for delivery.  In any event, time of delivery shall not be of the essence and we shall not be liable for any losses, costs, damages or expenses incurred by you or any third party arising directly or indirectly out of any failure to meet any estimated delivery date.

Delivery of the Goods shall be made to your address specified in the order and you shall make all arrangements necessary to take delivery of the Goods whenever they are tendered for delivery.

Risk in the Goods shall pass to you upon delivery of the Goods, or where you fail to take delivery at the agreed time, at the time delivery was attempted.

Delivery may be made, depending on the goods, on a HGV lorry. Reasonable access must be available to accommodate this. If in the event that delivery cannot be reasonably made the goods may be returned and you will be liable for delivery costs.

Deliveries to the Channel Islands, Northern Ireland, Isle of Man, Isle of Wight, Orkney, Shetland and Scottish Isles may incur an extra Delivery charge and may possibly incur an extended lead time. (Please note that certain items may not be deliverable to these areas). When delivery is requested for these areas it is recommended to call us for confirmation.
 

Cancellation and Return

You may cancel an order for any reason up to the point of dispatch and any payments made by you will be refunded in full within 5 days.

Refunds are made to original payment card or account.

You shall inspect the Goods immediately upon receipt and shall notify us by telephone or e-mail within 3 days if the Goods are damaged or do not comply with any of the Contract. If you fail to do so you shall be deemed to have accepted the Goods.

Where a claim of a defect or damage is made we shall be responsible for the recovery of the Goods from you within 28 days of delivery.  You shall be entitled to a replacement or a full refund (including delivery costs) if the Goods are in fact defective.

If you are a Consumer you have the right, in addition to your other rights, to cancel the Contract and receive a refund by informing us by letter, fax of e-mail within 14 days of receipt of the Goods. 
Goods must be returned by you at your expense within 14 days of cancellation in the original undamaged packaging and should be adequately insured during the return journey. When the Goods have been returned and are in merchantable quality, you will receive a refund of all monies paid for the Goods (including delivery charges, if any) except for return carriage charges. No refund will be made if you fail to return the Goods following cancellation.

Where returned Goods are found to be damaged due to your fault, you will be liable for the cost of remedying such damage.


Limitation of Liability

Except as may be implied by law where you are dealing as a Consumer, in the event of any breach of these Terms and Conditions by us the remedies of you shall be limited to damages which shall in no circumstances exceed the price of the Goods and we shall under no circumstances be liable for any indirect, incidental or consequential loss or damage whatever.

Nothing in these Terms and Conditions shall exclude or limit the liability of the Seller for death or personal injury resulting from the negligence of the Seller or that of the Seller’s agents or employees.

Force Majeure

We shall not be liable for any delay or failure to perform any of our obligations if the delay or failure results from events or circumstances outside our reasonable control, including but not limited to, acts of God, strikes, lock outs, accidents, war, fire, failure of any communications, telecommunications or computer system, breakdown of plant or machinery or shortage or unavailability of raw materials from a natural source of supply, and we shall be entitled to a reasonable extension of our obligations.

Changes to Terms and Conditions

We shall be entitled to alter these Terms and Conditions at any time but this right shall not affect the existing Terms and Conditions accepted by you upon making a purchase.

Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the law of Scotland and the parties hereby submit to the exclusive jurisdiction of the Scottish courts.
